NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. SWEEPSTAKES IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS. VOID WHERE PROHIBITED.
DATES: “B-Six Survey Giveaway” (the “Sweepstakes”) begins on September 14, 2021 and ends on September 16, 2021 at 11:59 pm (“Sweepstakes Period”). All times in the Sweepstakes refer to Pacific Time (“PT”).
ELIGIBILITY: This Sweepstakes is open to permanent, legal residents of, and who reside in, the fifty (50) United States or the District of Columbia (excluding Puerto Rico, Guam, the Virgin Islands and other United States territories), who are eighteen (18) years of age or older and of the age of majority in their state of residence at time of entry and who are the direct and intended recipient of an email invitation to the survey (“Survey Invitation”). Officers, directors, and employees of Thrasio, LLC (“Sponsor”), and its and their respective parent, subsidiary, and affiliate companies, and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes, and members of these persons’ immediate families (spouses and/or parents, children, and siblings, and each of their respective spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto), are not eligible. By entering this Sweepstakes, entrants indicate their full and unconditional agreement to, and acceptance of, these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Winning the Prize is contingent upon fulfilling all requirements set forth herein.
TO ENTER: You may submit one (1) Sweepstakes entry during the Sweepstakes Period by completing and submitting your survey responses via the link in the Survey Invitation (each an “Entry”). LIMIT OF ONE (1) ENTRY PER PERSON. Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void such Entries and that entrant may be disqualified, as determined by Sponsor in its sole discretion. The sole determinant of time for the purposes of receipt of a valid Entry in a Sweepstakes will be determined by Sponsor. Proof of submission (screen captures, etc.) does not constitute proof of entry. All Entries become property of the Sponsor and will not be returned.
Limit one (1) Entry per person. Multiple Entries will be void. Any attempt by any entrant to enter this Sweepstakes using multiple/different phone numbers or any other methods may void the entrant’s Entry and may result in disqualification, at the sole discretion of Sponsor. Entries generated by a script, macro, or other automated means or by any means that subverts the entry process detailed above will be disqualified. Entries must be received by the end of the Sweepstakes Period to be eligible.
PUBLICITY GRANT: Each winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes, in any manner, in all media now known or hereafter devised, worldwide in perpetuity, without additional compensation or notification to, or permission from, winner.
DRAWING: On or about September 21, 2021, potential winner(s) will be selected by Sponsor from among all eligible Entries received during the Sweepstakes Period. Odds of winning are dependent upon the total number of eligible Entries received during the Sweepstakes Period.
WINNER NOTIFICATION AND REQUIREMENTS: Potential winner will be notified by email on or about September 22, 2021 (the “Notification”). Potential winner will be required to respond to the Notification within the time period stated and provide all required information, which may include address of residence and email address. Potential winner may then be contacted by Sponsor via email and if requested by Sponsor, be required to complete an Affidavit of Eligibility/Liability/Publicity Release (unless prohibited) and an IRS W-9 Form (the “Winner Documents”) in order to claim the prize. Winner Documents must be completed and returned by the date and time indicated in the email. In the event a prize or prize notification is undeliverable or a potential winner (a) fails to respond to the Notification within the time period stated; (b) fails to supply all the required information or to timely provide the fully-executed Winner Documents (if required); or (c) is determined by the Sponsor, in its sole discretion, to be ineligible, such potential winner will be disqualified and an alternate winner will be selected from the remaining non-winning eligible Entries received during the Sweepstakes Period. Prize will be shipped to winner at the address provided at time of winner confirmation.
PRIZE(S): One (1) “Mystery Bundle” including a variety of Nippies™ brand products (Approximate Retail Value: $50). Winner(s) is/are solely responsible for any taxes, including, but not limited to, all applicable federal, state and local taxes that become due with respect to the acceptance and use of a prize. Sponsor, or a third party acting on its behalf, may be required to report the value of the prize to the Internal Revenue Service in the year the prize is received by the winner; and, in such case, the value of the prize will be reported to winner and the Internal Revenue Service in the form of a Form 1099 and/or other applicable tax forms. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winner. Winner may not substitute, assign or transfer prize, but Sponsor reserves the right, at its sole discretion, to substitute a prize of comparable or greater value. Prizes are not redeemable for cash. All prize details are at Sponsor’s sole discretion. Limit one (1) prize per person.
RELEASE OF LIABILITY: By entering the Sweepstakes, each entrant agrees for entrant and for entrant’s heirs, executors, and successors to release and hold harmless Sponsor and its parent, subsidiary, and affiliate companies, and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes, and each of their respective officers, directors, contractors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the or Sweepstakes and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof.
Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered, postage-due or garbled Entries, emails, text messages, notifications, mail or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of Entries, the announcement of the prize(s) or in any Sweepstakes-related materials.
Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer or other device related to or resulting from participating in this Sweepstakes.
GENERAL CONDITIONS: Sponsor reserves the right to permanently disqualify from any promotion any person it believes has intentionally violated these Official Rules. Any attempt to deliberately damage the Sweepstakes or the operation thereof is unlawful and subject to legal action by Sponsor, who may seek damages to the fullest extent permitted by law. Without limitation, Sponsor reserves the right in its sole discretion to disqualify any entrant (i) who does not comply with these Official Rules, or (ii) if Sponsor receives notification about any potential infringements or breaches of law or any other reason set forth herein.
In the event of a dispute regarding the identity of the person who submitted an entry, the entry will be deemed submitted by the Authorized Account Holder (defined below) of the e-mail address from which the Entry was submitted and such individual must comply with these Official Rules. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by the Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. An entrant may be requested to provide Sponsor with proof that the entrant is the Authorized Account Holder of the email address associated with the Entry.
Sponsor reserves the right to cancel, modify, or suspend the Sweepstakes or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, Sponsor reserves the right to select winner(s) in a random drawing from among all eligible, non-suspect Entries received prior to the time of the event warranting such cancellation, modification, or suspension or as otherwise deemed fair and appropriate by Sponsor. Notice of such cancellation, modification, or suspension will be posted on the Website. Sponsor may prohibit any entrant or potential entrant from participating in the Sweepstakes, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsor, or Sponsor’s agents or representatives; or behaves in any other disruptive manner (as determined by Sponsor in its sole discretion). Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.
The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, epidemic, pandemic, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules.
DISPUTES: THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK COUNTY, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION, INC., IN ACCORDANCE WITH ITS EXPEDITED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“AAA RULES”). THE AAA RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF UNITED STATES. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
PRIVACY: Personal information collected in connection with this Sweepstakes will be used on accordance with Sponsor’s privacy policy, located at https://b-six.com/policies/privacy-policy.
WINNERS LIST: To receive the name(s) of the winner(s), send an email to: support@b-six.com, by no later than thirty (30) days following the end of the Sweepstakes.
